A pending Federal law may well preempt New York’s vicarious liability law for motor vehicle lessors, says the New York State Trial Lawyers Association http://www.nystla.org.
A Federal law recently passed, but unsigned will limit vicarious liability for lessors, currently unlimited under the Vehicle and Traffic Law of New York. NYSTLA warns plaintiffs to file their cases before the President signs the bill.
New York is the last state to have unlimited vicarious liability for lessors.
