BROOKLYN: CASE AGAINST LAWYER TO GO AHEAD A federal judge in Brooklyn ruled yesterday that a malpractice lawsuit filed in May against Barry Scheck, a defense lawyer, could proceed, dashing Mr. Scheck’s hopes that the case would be immediately dismissed. The plaintiff, Lee Long, spent six years in prison for rape before a court ruled that he was innocent. He later retained Mr. Scheck, a prominent lawyer in wrongful-imprisonment cases and a leading advocate of DNA testing in criminal trials, to pursue damages against the state for wrongful imprisonment. Mr. Lee’s lawsuit alleges that Mr. Scheck and his firm, Cochran, Neufeld & Scheck, failed to file the necessary paperwork before the deadline for such lawsuits.Nicholas Confessore (NYT)
